The form below lists information which we need to write your
contract. However, we do not expect you to crawl around your
attic looking for your furnace model number, so please complete as
much of this form as you can--but
only the fields marked with "!" (name, address, phone) are
absolutely necessary for this form.
Contract: This agreement covers only the equipment list you have
provided below or which we get from you over the phone (or for
current customers, the equipment list we have on file for you). Our
final quoted price, subject to the terms and conditions on this page
(see The agreement, below),
shall constitute our offer, and your providing your credit card
information shall be considered your acceptance of our offer.
The agreement
Iceberg Mechanical, hereinafter referred
to as Iceberg Mechanical, shall perform two preventive maintenance
inspections per consecutive 12-month period. These inspections
will be performed on during regular working hours: 8am to 4pm
Monday through Friday, holidays excepted. This agreement does
not include any labor, materials or replacement parts necessary for
repairs of the listed equipment.
In the event that repair or replacement parts are necessary, the
customer or customer's representative shall be advised in writing.
Service calls shall be billed at current service rates charged
during normal working hours, including a
Trip Charge at our regular rates & labor charges.
After normal office hours, emergency service calls to Maintenance
Service Contract customers pay the standard trip charge
(non-Maintenance Service Contract customers pay the Emergency trip
charge for off-hours service.) Maintenance Service Contract
customers receive a 15% discount on repair parts & labor, and a 10% discount on
the purchase of new equipment: condenser, evaporator coil, gas
or electric heat, air handler and duct work. Maintenance
Service Contract customers get preference over non-MSC customers in
emergency service situations.
This agreement shall be effective immediately upon payment in full
and acceptance by both parties and will continue for one year (12
months) from the date of payment unless cancelled by either party
giving 30 days advance written notice. This agreement will
automatically renew by execution of a new Maintenance Service
Contract and payment of invoice each year.
Iceberg Mechanical reserves the right to adjust the renewal rate of
this agreement due to labor price changes, and the customer shall
have an opportunity to accept these changes or terminate the
agreement. Payment shall be made upon receipt of statement.
Customer acknowledges that failure to make a payment when due shall
relieve Iceberg Mechanical of the obligation to perform any further
service under this agreement.
Iceberg Mechanical shall use ordinary care in performing the
preventive maintenance inspections service, but shall not be liable
for failure to discover conditions necessitating future repairs or
replacements, nor shall any inspection be construed as an approval
or absolute guarantee of the condition of the equipment.
During the term of this agreement, we will take all reasonable
precautions to avoid injury to persons and damage to property while
on the premises, but we shall not be liable for any special or
consequential damages. We shall not be responsible for system
design nor maintaining design conditions.
We are not responsible for failure or damage to the equipment or
premises due to improper fuel or power supply. We are not
responsible for drains or their function or electrical problems
beyond the equipment proper. Iceberg Mechanical makes no other
warranties, expressed or implied. This agreement covers the
complete understanding between the parties, except for provisions
modified by the online application.
